Abstrakt: Wolność religii a wymóg obywatelstwa polskiego członków wyznaniowej gminy żydowskiej
W prezentowanym opracowaniu przedstawiono zagadnienie zgodności z Konstytucją RP przepisów ustawy z dnia 20 lutego 1997 roku o stosunku państwa do gmin wyznaniowych żydowskich w Rzeczypospolitej Polskiej, która wprowadza wymóg posiadania obywatelstwa polskiego dla członków gminy żydowskiej. Zdaniem autorki, która powołuje się w tym przedmiocie na stanowisko Trybunału Konstytucyjnego, zapisy omawianej ustawy naruszają przede wszystkim zasadę wolności sumienia i religii, dyskryminując społeczność wyznania mojżeszowego. Krytyce poddano również zapisy ustaw religijnych, które wprowadzają warunek posiadania obywatelstwa polskiego dla osób chcących piastować niektóre stanowiska i urzędy duchowne, jak też korzystać z czynnego i biernego prawa wyborczego w niektórych związkach wyznaniowych.

Abstract: Freedom of religion and the requirement of Polish citizenship to members of the Jewish community
The following paper presents the issue of compliance with the Constitution of the Republic of Poland, the Act of 20 February 1997. Relation of the State to the Jewish communities in the Polish Republic, which introduces a requirement to have Polish citizenship for members of the Jewish community. According to the author, who refers in this regard to the position of the Constitutional Tribunal, the provisions of the law in question violate primarily the principle of freedom of conscience and religion, discriminating against the Jewish faith community. Critique were also records of another acts, which introduce the condition of Polish citizenship for people who want to hold some positions of the clergy, as well as the use of active and passive voting rights in some of the religious association.
